LUV accident at Midway

JURISDICTION – A plane crashed through a barrier into the street and hit a car, killing one of the car’s occupants. The 7th Circuit reversed the district court’s ruling that the ensuing tort suits fell under federal court jurisdiction because no court of appeals has held that the national regulation of most aspects of air travel meant that a tort claim in the wake of a plane crash fell under federal law.
